With the aim of ensuring the right to Private Property, provided for in article 62 of the Constitution of the Portuguese Republic, Decree-Law No. 43/2024, of 2nd of July, which repeals article 108.º-C of Decree-Law no. 555/99, of 16th December, which establishes the Legal Regime of Urbanization and Urban Building, and which provides for forced leasing of vacant housing.


With the publication of this Government Decree-Law, the forced leasing of vacant housing is revoked.

This diploma also extends extraordinary support to families to pay rent and bank credits.

 

This support is based, by the Government, on the fact that a significant number of rental contracts signed until March 15, 2023, were terminated at the initiative of the respective landlords, and were followed by the signing of new contracts, with the same purpose and the same parties, which meant that some tenants were no longer able to benefit from the extraordinary support for families to pay their rent, approved by Decree-Law no. 20-B/2023, of March 22, in its current wording. 

 

For this reason, it has now been decided to extend this support regime to all tenants with rental contracts in force in the aforementioned situation, through verification by the Tax Authority, due to the mandatory communication of these contracts.

 

This temporary and exceptional measure, scheduled until December 2028, aims to maintain extraordinary support for tenants and sub-tenants covered by it, in an amount that could reach 200 Euros per month, paid by social security, seeking to increase families' disposable income and observe the principle of equality.
